For purposes of this Privacy Notice, it will be understood that when referring to Delta Group, its Affiliates are included in this definition. “Affiliates” means, with respect to Delta Group, any natural or legal person, including any company, civil partnership, association, entity, trust, and/or organization of any kind (hereinafter a “Person”), which directly or indirectly through one or more intermediaries, controls, is controlled by, or is under common control of any other person.

This privacy notice applies only to Grupo Delta whose website is: https://www.gdelta.com.mx/, hereinafter identified indistinctly as the “Portal” owned by Desarrollos Urbanos Delta, S.A. de C.V. or its Affiliates.
For purposes of this Privacy Notice, a USER shall be: (i) the public in general and/or (ii) a customer of Desarrollos Urbanos Delta, S.A. de C.V. or its Affiliates, who has entered into any Contract for the provision of Services, (the “USER”). The USER fully and unconditionally accepts each and every one of the provisions of this Privacy Notice, published permanently on this Portal. This Privacy Notice shall refer to the Terms and Conditions for every other assumption not defined herein.
Desarrollos Urbanos Delta, S.A. de C.V. or its Affiliates, reserves the right to make changes or updates to the Privacy Notice at any time to respond to legislative developments, internal policies or new requirements for the provision or offer of our services or products. The USER acknowledges that they freely and willingly enter and provide their personal information, (“Personal Information” or “Personal Data”), to the Portal and/or to Desarrollos Urbanos Delta, S.A. de C.V. or its Affiliates.
Desarrollos Urbanos Delta, S.A. de C.V. is responsible for the processing of personal data that it collects and with respect to the right to privacy and informational self-determination of individuals in compliance with Article 16 of the Constitution and the provisions established in the Ley Federal de Protección de datos Personales en Posesión de los Particulares (Federal Law on Protection of Personal Data Held by Private Parties) hereinafter the “LFPDPPP, and its Regulations, taking into account the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility.

2. PURPOSE OF PROCESSING PERSONAL DATA.
The company Desarrollos Urbanos Delta, S.A. de C.V. uses the personal data of Mexican citizens such as, full name, address, place and date of birth, email, Unique Population Registry Code (Clave Única de Registro de Población), Taxpayer Identification Number (Registro Federal de Contribuyente), landline and/or cell phone numbers and billing data such as (name of the individual or company, taxpayer identification number, tax address, zip code, town, place of work, nationality, place of birth, occupation among others), for the following purposes:

c) Business
d) Service Supply.
3. TRANSFERS.
USER’S personal data can be processed inside and outside the Mexican Republic. Desarrollos Urbanos Delta, S.A. de C.V. or its Affiliates, may transfer your personal data to third parties, in terms of the provisions of Article 37 of the Federal Law on Protection of Personal Data Held by Private Parties, when: (i) the transfer is made to controlling companies, subsidiaries or Affiliates under the common control of the responsible party, or to a parent company or any company of the responsible group operating under the same internal processes and policies; (ii) the transfer is provided for in a Law or Treaty which Mexico is a party of; (iii) the transfer is necessary by virtue of a contract, executed or to be executed in interest of the owner of such information, by the responsible party and a third party; (iv) the transfer is necessary or legally required to safeguard a public interest, or for the procurement or administration of justice; (v) the transfer is necessary for the recognition, exercise or defense of a right in a judicial process; and/or (vi) the transfer is necessary for the maintenance or fulfillment of a legal relationship between the responsible party and the USER, owner of the personal data.
If the USER does not express their opposition to the transfer of their personal data, it will be understood that they have given their consent to do so.
4. CONTACT.
The USER has the right to access his/her personal data and the details of the processing thereof, as well as to rectify them if they are inaccurate or incomplete; cancel them when they consider that they are not required for any of the purposes indicated in this Privacy Notice, when they are being used for purposes not consented, or the contractual or service relationship has concluded, or to oppose against the treatment thereof for specific purposes.
Desarrollos Urbanos Delta, S.A. de C.V., with business domicile located in Santa Catarina, N.L., Mexico, through its Person Responsible for the Processing of Personal Data, Mayra Lizeth Garza Rodriguez, puts at your disposal the following email address info@ddelta.mx, as well as the telephone number 81 8401 1000, to attend any request related to access rights, rectification, cancellation or opposition to the use of your personal data (ARCO rights), As well as to attend to any request for revocation of consent for the processing of Personal Data, which will be answered in accordance with the deadlines established in the LFPDPPP. This request must include: (i) the (ARCO) right that you wish to exercise, (ii) name and/or company name, taxpayer identification number and contact number, (iii) documents proving your personality (copy of an official identification or power of attorney in public deed); the request will be processed and answered by email or at the registered address within 2 (two) days after receiving the request.
If the USER considers that their right to protect their personal data has been affected by any conduct of Desarrollos Urbanos Delta, S.A. de C.V., the USER may file the corresponding complaint before the Federal Institute for Access and Protection of Information (IFAI) through the Portal www.ifai.org.mx.
5. LIMITED LIABILITY.
To the maximum extent permitted by applicable law, Desarrollos Urbanos Delta, S.A. de C.V. or its Affiliates shall not be liable under any circumstance for any direct, indirect, special, incidental or consequential damages arising in any way from or related to: (i) the use or running of the Portal; (ii) a delay or unavailability of using the Portal; (iii) the provision or non-provision of any information, or graphics contained or published on or through the Portal (iv) an update or failure to update any information; (v) the alteration of modification of any information, in whole or in part, after being added to the Portal; (vi) any other aspect or characteristic of the information contained or published on the Portal or through the links that may be included in it; (vii) the provision or non-provision of services.
Desarrollos Urbanos Delta, S.A. de C.V. or its Affiliates, is not, and will not be responsible for the use, content, veracity, quality or accuracy of the information contained in the website, including but not limited to, information published by Desarrollos Urbanos Delta, S.A. de C.V. or its Affiliates, and/or any information provided by the USER by any means.
The USER expressly releases Desarrollos Urbanos Delta, S.A. de C.V. and its Affiliates from any liability arising from the foregoing and agrees to hold Desarrollos Urbanos Delta, S.A. de C.V. or its Affiliates free and clear of any harm, covering the damages and losses that may occur due to the claims that: (i) any third party may file; (ii) arise from any requirement, claim and/or judicial and/or administrative proceeding derived from any breach of obligations by the USER as provided for in current legislation and/or those that may acquire or have acquired.
6. AMENDMENTS.
Desarrollos Urbanos Delta, S.A. de C.V. or its Affiliates, may unilaterally, at any time, to comply with current legislation and/or when it deems appropriate, make amendments, additions, improvements or modifications to the content, presentation, information, services, areas, databases and other elements of the Portal. The USER acknowledges that they are not entitled to any claim, compensation and/or payment of damages caused by the changes made.
7. LIMITATION OR REVOCATION OF THE PROCESSING OF YOUR DATA.
At any time, you may limit the use and disclosure of your personal data and⁄or revoke the consent you have given us for the processing thereof, so that we stop making use of them. To such effect, it is necessary that you submit your request by email to info@ddelta.mx complying with the same requirements and the same procedure as indicated for the exercise of your Arco Rights.
However, in case of revocation of use of your personal data, it is important to keep in mind that not in all cases we will be able to respond to your request or terminate the use immediately, since it is possible that by some legal obligation we require to continue processing your personal data. 13. APPLICABLE LAW AND JURISDICTION.
This instrument shall be ruled by and construed in accordance with the laws of the United Mexican States. Any dispute arising from the interpretation or execution of the Privacy Notice, shall be submitted to the exclusive jurisdiction of the competent courts in the city of Monterrey, Nuevo Leon, Mexico, so the USER waives any other jurisdiction that may be applicable due to their current or future domiciles or any other circumstance.
